Lease Forfeiture & Commercial Evictions

Lease forfeiture occurs when a tenant breaches the terms of a lease agreement, typically by failing to pay rent or violating other significant provisions contained within the lease. In such cases, the landlord may terminate the lease and regain possession of the property.

A commercial lease will likely contain a "Forfeiture of Lease" clause, enabling the landlord to re-enter the commercial premises if the tenant has broken the lease agreement. Typically, this will be for non-payment of rent (for late rent payments, please visit our CRAR page). Other reasons for activating a commercial eviction may include non-payment of service charges or a breach of a covenant contained within the lease agreement.

The landlord must act quickly to initiate "Forfeiture of Lease", or they could be considered to have waived their right to do so. Therefore, contacting an Enforcement Agent promptly is paramount.

How it works

Upon written instruction, Elite Enforcement Services will attend your property, usually outside trading hours. Alongside our Locksmith, we will gain peaceful entry and immediately change the locks. If required, we will carry out an inventory and display relevant notices on all entrance doors.

We will then provide the Landlord or Agent with the new keys to the property.

Should the tenant wish to claim back goods stored inside the premises, it can be arranged for Elite Enforcement Services to supervise access to allow recovery of goods. 

It is important to note that under the Torts (Interference with Goods) Act 1977 goods inside the property cannot be immediately disposed of. Before removing any goods, we recommend seeking legal advice.

INSTRUCT US

Door notices will include:

  • A statement indicating the tenant should note that the landlord has forfeited the lease by re-entering the property.
  • Details of the relevant clause under which the lease authorises the landlord to forfeiture.
  • A statement that only those authorised by the landlord can lawfully enter, and any attempt otherwise will be a criminal offence.
  • A Torts notice, giving the tenant at least 14 days' notice that they need to move their belongings.
  • Contact details for the landlord or its agent.

We only accept BACS payments for services.

All payments to yourselves are made pro rata.

All payments should be directed to us from the debtor so that we have full control of your case and payments. If any payments are made to yourself from the debtor, you must declare it to us immediately so we can amend the balance/payments pro rata.

All fees are collected first and foremost.

If any payment made by yourself is recalled, even if it's out of your control, you agree to pay back those funds with immediate effect. During this period, your account will remain unpaid.

A Late payment charge of £25 will be applied to all late payments and 8% per annum of the total debt.
